Please note the following, detailing all terms and conditions, and other appropriate policies of Dr. Jacqueline S. Chan, DO, A Medical Corporation (hereafter, “Dr. Chan”), as well as the manner in which Dr. Chan collects, uses, maintains and discloses information collected from all customers, clients, and all other individuals (hereafter, “Customer”), to www.drjacqueline.com, and for all other programs, products, and services offered.

Privacy Policy: Dr. Chan holds all private information in the strictest confidence and will never sell, rent, distribute or share private financial and/or contact information to any third-party vendors, marketers or any and all other non-governmental entity or individual unless required by law. Submitted emails constitute agreement of marketing emails from drjacqueline.com; Dr. Chan never sends unsolicited commercial email. Any and all individuals may unsubscribe by following instructions contained in every email, or by emailing [email protected], or by sending a letter to: Dr. Jacqueline S. Chan, DO, 35 Miller Ave #202, Mill Valley, CA, 94941. All collected & sensitive information is stored in a technically and physically secure environment, encrypted and protected with SSL encryption software. Transmitted data to Dr. Chan is done at own risk. Any and all attempts to breach the security of any Dr. Chan’s network, servers, databases or other hardware or software supporting or under the control of Dr. Chan constitutes a crime punishable by law and financial remedial measures. Refund and Return Procedures: Any and all requests for refunds must be received in writing, either by emailing Dr. Chan at [email protected], or by sending a letter to: Dr. Jacqueline S. Chan, DO, 35 Miller Ave #202, Mill Valley, CA, 94941. Dr. Chan shall acknowledge request within 48 hours, or within two business days; all requests for refunds shall be reviewed on a case by case basis. Send any and all materials approved for return to: Dr. Jacqueline S. Chan, DO, 35 Miller Ave #202, Mill Valley, CA, 94941; no returns will be accepted without prior authorization. Materials may not be returned at any subsequent live class, event, seminar or any and all other Dr. Chan venues. Refund requests must include all the following for consideration:
1. The return of all materials in original, unopened condition
2. The product package tracking number when returning/shipping product
3. Full name, email, complete address, phone (including area code) 
4. The complete reason for cancellation or return 
5. Copy of paid invoice or sales receipt
A customer service representative shall respond within 48 hours. Dr. Chan reserves the right to choose payment method of refund. Upon approval, refunds are disbursed within thirty (30) business days of receipt of any and all materials, if applicable. Materials returned in damaged state may nullify refund. Shipping and handling charges are non-refundable. Dr. Chan reserves the right to deny any refunds. Customer agrees to follow standard refund procedures and will not pursue any credit card charge backs. In the event a credit card is declined, Dr. Chan will attempt to claim funds up to three separate times before suspension occurs. All check payments returned unpaid may be resubmitted electronically either directly or through a third-party payment and/or collection service. Customer is responsible for any and all returned check fees. Any checks or charges left unpaid are considered fraudulent and subject to collection and/or subsequent prosecution.

Dr. Chan Live Programs, Classes, Products or Event Returns: All sales made at a live event have a 72 hour right to rescind policy from the date of the order; all sales shall then be final. Upon refund request by emailing Dr. Chan at [email protected], or by sending a letter to: Dr. Jacqueline S. Chan, DO, 35 Miller Ave #202, Mill Valley, CA, 94941, a customer service representative will respond within 48 hours of receipt of written request. Dr. Chan reserves the right to choose payment method of refund. Upon approval, refunds are disbursed within thirty (30) business days of receipts of any and all materials, if applicable. Customer is responsible for any and all returned check fees. Any checks or charges left unpaid are considered fraudulent and subject to collection and/or subsequent prosecution.

Dr. Chan Promoted Speaker Classes, Events, Products and/or Programs Returns: Speakers promoted by Dr. Chan are third-party vendors only. Therefore, the education provided by any and all speakers is provided as a service and does not represent an endorsement or recommendation by Dr. Chan of any individual or company. Dr. Chan is not responsible for the accuracy or reliability of any educational information or monetary claim provided by any third-party vendor or speaker through their classes, events, products or programs. Any and all third-party speaker or vendor refund requests must be pursued with the appropriate Speaker or vendor first. If unable to obtain satisfaction, see applicable Dr. Chan return policies; documentation of third-party return attempts will be requested.

Electronic Recordkeeping: Customer acknowledges and agrees that company/customer documents may be stored in an electronic recordkeeping system in the regular course of business, and that a printed copy of the imaged document may be used and introduced in any arbitration, litigation or other proceeding, and shall have the same force and effect as the original, which may be destroyed.

Copyright: Reproduction of copyrighted materials, including but not limited to, digital and/or physical audios, videos, printed materials, or other materials received from company or downloaded from website is prohibited by law. US copyright laws may impose fines up to $25,000 for illegally copying protected publications. Furthermore, redistribution of any materials without expressed and written consent is a Federal crime punishable by fines and Federal prison.

Disclaimer: Customer acknowledges that Dr. Chan made no representation or guarantees other than those expressed herein. Customer has not relied thereon, and Dr. Chan specifically disclaims, any other representations or warranties. Customer acknowledges that all materials and information are provided for educational purposes only, and should be used in conjunction with competent professional and/or medical advice and counsel, and is not ascertaining the suitability of any program for Customer. This policy represents the entire understanding, and supersedes all prior statements, agreements, and understandings, if any, either oral or written. Testimonials included may not represent typical results, and unique experiences and past performances do not guarantee future results. Dr. Chan’s sub-contractors, employees, and affiliates may not give medical advice, and may not licensed by or registered with any federal or state agency.

Law and Arbitration: The parties waive trial by court of jury. Any dispute arising from, or relating to, any class, program, event, or product, or any other third party class, program, event or product, or the legitimacy of any dispute shall be resolved by arbitration in Mill Valley, CA, where company operates, and accepted and governed under the construed CA law, except its conflict of laws rule. A party shall not be permitted to bring a claim sounding in tort or otherwise. No party may bring or become a member of a class action against another. (“Claimant”) shall select an arbitrator and notify the other party (“Respondent”) in writing by USPS Certified Mail (Return Receipt Requested), of the nature of the claim and the arbitrator’s name. Respondent shall have twenty (20) days from the receipt of the notice to select the second arbitrator and notify Claimant in writing, via the same type of mail, of the second arbitrator’s name and the nature of any defense. These arbitrators shall select, at their sole discretion, a third arbitrator to complete the panel. If a party fails to select an arbitrator in a timely fashion, then a final decision in favor of the other party shall be entered by the latter’s arbitrator. Each arbitrator must be a lawyer with over ten (10) years’ experience or a retired judge. The arbitrator’s decisions shall be by a majority vote, final, and binding. No party shall be awarded attorney’s fees or cost, (whether or not taxable by a court or arbitrator’s) as cost. No action filed more than twenty-one (21) months after the enrollment date shall be entertained by any arbitrator or court. If awarded, the total of all damages shall not exceed the purchase price paid hereunder. Any proceedings, whether or not consistent with this agreement shall be filed or entered into only by a court in Mill Valley, CA, having jurisdiction thereof. Customer acknowledges that competing product, and services, are readily available and therefore waives any right to assert that this enrollment form is a contract of adhesion or that any provision of it is unconscionable.

Severability: If any provision of any enrollment of any company class, program, or event shall be held un-enforceable, such provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of the enrollment shall otherwise remain in full force and effect.

Limitations of Use: Dr. Chan’s classes, programs, events, and other materials are designed for personal use only. Customer agrees only Customer shall use materials and shall not resell or otherwise distribute the original or any copy of the program materials in any manner or any part thereof, in any manner, and shall not allow others to do so. Any violation of this policy may lead to prosecution under State or Federal law, or both.

Services Offered/Theoretical Approach: Dr. Chan works with Clients in a number of areas including, a wide variety of life issues, overall health and wellness, nutrition, and recovery from illness or injuries. Her focus with a Client is to work with the whole person, using techniques and methods designed to assist the Client in achieving balance in mind, body, and spirit. Specifically, Dr. Chan offers several innovative energy-based techniques based on the newly emerging field of energy medicine (the “Energy Methods”). Any Client has the option of using individually, or collectively, any of the Energy Methods and other services offered.

Energy Medicine: Energy medicine is a collective term used to refer to a to a variety of energy techniques based on the use, modification, and manipulation of energy fields that assess where the body’s energies are blocked or not in harmony. The flow of these energies are then corrected and balanced, thereby aligning the body’s energies to boost health, vitality, and restore the body’s natural energies. The prevailing premise of energy medicine is that the flow and balance of the body’s electromagnetic and more subtle energies are important for physical, spiritual, and emotional health, and for fostering well-being. Energy medicine, while controversial in some medical quarters, has a long traditional history across many cultures, and for which there is some evidence that it can have a healing benefit. It is an approach in which the practitioner, either through his or her consciousness or aided by a product, channels life energy for healing benefit. While energy medicine is not used for medical decision-making, it can function in a supportive capacity. Specifically, Dr. Chan offers the Energy Methods.

Nature of the Relationship: Dr. Chan is a licensed Doctor of Osteopathic Medicine in the State of California, by signing this document, all Clients understand services are offered solely as an energy wellness practitioner. Dr. Chan is not providing medical services, and will not diagnose, treat, or manage medical or mental health disorders. All Clients are encouraged to seek an additional diagnosis, or any other type of treatment or services from any other practitioner at any time as wanted. When using the Energy Methods, Dr. Chan is not diagnosing or treating the physical body, but instead, as an energy wellness practitioner, Dr. Chan connects to the energy or subtle bodies of the Client, which then can manifest in the physical body; understand there is a distinction between healing using the Energy Methods, and the practice of medicine, or any other licensed health care practice. Although the Energy Methods appear to have promising emotional, spiritual, and physical health benefits, they have yet to be fully researched by the Western academic, medical, and psychological communities, and therefore, could be considered experimental. By signing this document you understand the Energy Methods are considered alternative or complementary to the healing arts that are licensed in the United States.

Limitations of Practice: Please be advised services offered as an energy wellness practitioner, and the use of the Energy Methods, are not intended to be a substitute for the diagnosis and/or treatment of medical conditions or psychological disorders, and they do not replace the services of health care professionals. All Clients agree and understand it is their responsibility to consult with preferred health care providers for any specific health care problems. Furthermore, all Clients understand Dr. Chan may suggest contact be made with a professional health care provider if believed advisable. In addition, all Clients understand that any information shared during sessions with Dr. Chan is not to be considered a recommendation to stop seeing any current health care professionals, or to cease use of any prescribed medication, if any, without consulting current health care professional, even if it appears and indicates that such medication or treatment is unnecessary.

Outcome Expectations/Risk & Benefits: Please note that it is impossible to guarantee any specific results, and how any Client responds to the Energy Methods is unknown. However, Dr. Chan shall work together with all Clients to achieve the best possible results. Participation in a wellness program can result in a number of benefits, including improvement in overall health and well-being, and resolution of any specific concerns that led Client to seek help. Most Clients report pleasant experiences with using the Energy Methods, and they are generally considered gentle and non-invasive. However, it is possible that Clients in session with Dr. Chan, or on their own between sessions, to experience some physical discomfort or emotional distress which could be perceived as negative side effects. Occasionally, some people have experienced dizziness, nausea, or anxiety as occasional side-effects from energy work. All Clients are strongly recommended to contact Dr. Chan immediately if any method or process leads to distress or discomfort.

Confidentiality: All work with Dr. Chan, including any basic personal acknowledgement, introductions, shall be kept completely confidential, except as provided by law, without prior, written permission. All Clients may direct Dr. Chan to share information with specific Clients as appropriate and as wanted; permission to share information may be revoked at any time.

Education and Training: Dr. Chan has a Master Certificate Intuition Medicine from the Academy of Intuition Medicine, and Certification in Bioresonance Analysis of Analysis of Health & ACMOS granted by Innovative Medicine. She has fifteen years’ experience as an integrative medical doctor with a busy practice at Marin Natural Medicine Clinic in Larkspur. She spent five years as a member of the prestigious Integrative Medical Group, CLEAR Center of Health, in Mill Valley, and is Board Eligible in Family Practice, Board Certified in Holistic Medicine and Board Certified in Neuromuscular and Skeletal Medicine. She is a member of American College for the Advancement of Medicine, American Holistic Medical Association, American Academy of Osteopathy, the Cranial Academy, and the American Osteopathic Association.

Acknowledgement and Consent to Receive Services: By agreeing and signing digital or physical version of Client Agreement, Program Disclosure, and Consent to Receive Services, Client agrees that Dr. Chan has disclosed sufficient information to enable an informed decision whether to move forward with any services offered. Client has considered all of the above information, and has obtained whatever information or professional advice deemed necessary to make an informed decision. Client understands Dr. Chan is offering services solely as an energy wellness practitioner, and is not providing medical services, nor will diagnose, treat, or manage any medical or mental health disorders. Client accepts responsibility to maintain a relationship with a health care professional as wanted. Consent to the nature of any sessions (complimentary or compensated) with Dr. Chan is given voluntarily, without coercion, and may be withdrawn at any time. Further, Client is represented to be competent and able to understand the nature and consequences of the proposed sessions, and agrees to be personally responsible for the fees related thereto. It is understood that the Energy Methods are relatively new healing approaches, and the extent of their effectiveness, as well as their risks and benefits are not fully known. Therefore, Client agrees to assume and accept full responsibility for any and all risks associated with using the Energy Methods to the fullest extent allowed by law. Client acknowledges receipt of Dr. Chan’s Office Policies & Procedures, attached hereto, and incorporated herein by reference. By signing in the space provided below, Client knowingly, voluntarily, and intelligently assumes these risks and agrees to release, indemnify, hold harmless and defend Energy Wellness, a division of Jacqueline S. Chan, A Medical Corporation, its board of directors, officers, employees, representatives, independent contractors, and consultants from and against any and all claims of whatsoever kind or nature, which Client, or their representatives, may have for any loss, damage, or injury arising out of or in connection with their work with Dr. Chan. If Agreement is submitted electronically, typing your name in the space provided shall be considered your signature, and constitutes your acceptance of this Agreement.
